1. Identity and scope
Eindhoven Creative Community (ECC) is an informal initiative without its own legal entity or Chamber of Commerce registration, jointly organised by Pieter van Engeland, Frank van de Ven and Yamil Baptista. These terms apply to the website, free community participation and ECC activities unless specific additional terms apply. “Member” is a community term and does not mean legal membership of an association.
2. Purpose
ECC connects photographers, filmmakers and other visual makers in and around Eindhoven for meeting, knowledge sharing, creative activities and collaborative projects. Participation is currently free and does not guarantee assignments, reach, publication or commercial benefit.
3. Applications and admission
Applicants provide correct and current information. Before an online application can be submitted, the applicant is asked to agree to these terms; the terms can be opened and saved from the form. ECC records the accepted terms version with the application. ECC may reasonably refuse an application where it conflicts with the community's purpose, safety, these terms or third-party rights. Admission decisions are not applied discriminatorily.
4. Public profiles are optional
Community participation does not require a public profile. A member who voluntarily chooses a public profile gives separate consent to publish selected information and images. That choice can later be withdrawn; ECC will hide or remove the profile as soon as reasonably possible and within 30 days of a valid request.
5. Conduct
- respect other participants and their boundaries;
- no threats, harassment, discrimination, stalking or deliberate nuisance;
- do not disclose confidential personal data without a valid reason;
- only share content for which you have the necessary rights;
- do not use ECC for spam, unwanted mass commercial solicitation or technical abuse;
- follow reasonable safety and venue instructions.
6. Member and participant content
Creators retain copyright in their own work unless expressly agreed otherwise. Content supplied for a particular ECC profile or event gives ECC only the limited rights needed for the agreed use.
7. Event suggestions and ECC activities
ECC reviews event suggestions before publication and may make reasonable editorial/technical changes. ECC may organise activities and reasonably change, move or cancel them for safety, weather, illness, insufficient participation or circumstances outside ECC's reasonable control. ECC currently does not charge participation fees or receive donations. If ECC starts taking payments, specific pricing, cancellation, refund and consumer information will be provided before payment.
8. Photography and video
ECC organisers and participants may take photographs or video. ECC may use its own imagery on its website, social media, newsletter and archive in line with the Privacy Statement. Participation is not unlimited consent for all image use.
9. Event polls and newsletter
Event polls are voluntary and are not reservations or tickets. Newsletter signup is voluntary and separate from community membership, events and the competition. ECC uses Mailchimp with single opt-in: a person is subscribed immediately only after an explicit newsletter signup. The newsletter is sent monthly. Unsubscribe options and tracking are described in the Privacy Statement.
10. Eindhoven Photography Challenge
The separate competition rules apply in addition to these terms. For competition-specific issues, those rules take precedence.
11. External services, availability and liability
Links to external venues, events, platforms or portfolios do not automatically make ECC the organiser or contracting party. ECC aims to keep the website safe and available but cannot guarantee uninterrupted operation. Nothing in these terms excludes liability or mandatory rights where Dutch law does not permit that.
12. Ending participation, privacy and changes
You may end community participation by contacting hello@eindhovencreativecommunity.nl. ECC may end participation for serious/repeated breaches, safety risks or abuse. Personal data is handled according to the Privacy Statement. ECC may update these terms when the community, website, activities or law changes.
13. Dutch law and contact
Dutch law applies. Mandatory protections remain in force and disputes are submitted to the legally competent court.
